These Terms & Conditions govern your access to and use of the Koala Learning Resources website and your purchase of products from us.
By accessing our website, creating an account, placing an order or purchasing products from Koala Learning Resources, you agree to these Terms & Conditions.
These Terms & Conditions operate subject to the Australian Consumer Law (ACL) and other applicable Australian laws. Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.

- Natural Materials
Some Koala Learning Resources products are made from natural materials, including wood.
Natural characteristics such as differences in grain, texture, tone, knots and colouring may occur.

However, this does not limit any rights you may have under the Australian Consumer Law where a product is faulty, unsafe, materially different from its description or otherwise fails to meet an applicable consumer guarantee.
- Product Availability
All products are subject to availability.
Adding an item to your shopping cart does not necessarily reserve that item.
Occasionally, a product may become unavailable after an order has been submitted.
If we cannot supply an ordered product, we will contact you and provide an appropriate resolution, which may include a refund for the unavailable product.
We will not knowingly accept payment for products that we do not intend to supply.
- Orders
When you submit an order, you are offering to purchase the products in that order subject to these Terms & Conditions.
We may need to verify information relating to an order before processing it.
An order may be declined or cancelled where there is a legitimate reason, including where:
- a product is unavailable;
- payment cannot be authorised;
- incorrect pricing or product information has resulted from a genuine error;
- we reasonably suspect fraudulent activity;
- delivery cannot reasonably be made to the supplied address; or
- accepting or fulfilling the order would breach applicable law.
Where we cancel an order after receiving payment and you are entitled to a refund, we will refund the relevant amount.

- Pricing
Unless otherwise stated, prices displayed on our Australian website are in Australian dollars (AUD).
Prices will include GST where GST is applicable and required to be included.
Delivery charges and any other applicable charges will be displayed or calculated during checkout before you complete your purchase, where applicable.
We may change product prices from time to time.
A price change will not ordinarily affect an order already accepted at the agreed price, except where permitted by law or where an obvious pricing error needs to be addressed before fulfilment.
- Pricing and Website Errors
We take reasonable care to ensure website information is accurate.
Occasionally, typographical, technical, pricing or inventory errors may occur.
Where an obvious error affects an order, we may contact you before fulfilling the order to explain the issue and provide available options.
We will not substitute a materially different product or impose an increased price on an accepted order without your agreement where doing so would be inconsistent with applicable law.
- Payments

By submitting payment information, you confirm that you are authorised to use the selected payment method.
Payment transactions may be processed by third-party payment providers.
Koala Learning Resources does not necessarily directly store complete payment-card information where payments are processed through third-party payment gateways.

- Shipping and Delivery
Orders will be delivered to the delivery address supplied during checkout.
Delivery times displayed on our website are estimates unless expressly stated otherwise.
Delivery times may be affected by circumstances including:
- destination;
- carrier delays;
- public holidays;
- severe weather;
- peak trading periods;
- stock availability; and
- circumstances outside our reasonable control.
We will comply with our obligations under Australian Consumer Law where products are not supplied within an agreed time or, where no time was agreed, within a reasonable time. The ACCC confirms that businesses that cannot supply paid-for products on time or within a reasonable time must provide an appropriate solution.
- Delivery Address
Customers are responsible for providing a complete and accurate delivery address.
If an order cannot be delivered because the customer supplied incorrect or incomplete delivery information, reasonable additional delivery costs may apply where permitted by law.
Please contact us as soon as possible if you notice an error in your delivery information.
- Authority to Leave
Where a customer or delivery option authorises a carrier to leave a parcel without obtaining a signature, delivery will be handled according to the applicable carrier instructions.
Nothing in this section excludes rights or remedies that cannot lawfully be excluded.
- Children’s Products and Adult Supervision
Koala Learning Resources supplies products for different ages, developmental stages and educational purposes.
Customers are responsible for reviewing and following all:
- age recommendations;
- safety warnings;
- assembly instructions;
- usage instructions; and
- supervision requirements
provided with or relating to a product.
Some products may contain small parts, magnets, loose components or other components unsuitable for younger children.
Products should only be used for their intended purpose and with appropriate adult supervision where required.

- Educational Information
Product descriptions may contain information about potential educational applications, developmental skills, learning opportunities, curriculum connections or EYLF outcomes.
This information is provided for general educational guidance.
References to learning outcomes describe ways educators or families may use the resource and do not guarantee a particular developmental, behavioural, therapeutic or educational outcome for an individual child.
Resources should be selected and used according to the child’s age, abilities, individual needs and applicable safety requirements.
- EYLF References
Where we refer to the Early Years Learning Framework (EYLF) or other educational frameworks, these references are intended to assist educators in considering possible curriculum connections.
The actual learning that occurs depends on factors including the learning experience, educator practice, environment and individual child.
Unless expressly stated, Koala Learning Resources does not represent that a product is officially endorsed by the Australian Government or the authors or administrators of the EYLF.
- Australian Consumer Law
All products sold by Koala Learning Resources are supplied subject to applicable consumer guarantees under the Australian Consumer Law.
Consumer guarantees apply automatically and cannot be removed by website Terms & Conditions.
Where applicable:
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
This is the statutory wording specified for goods by the ACCC.
- Returns, Refunds and Exchanges
Returns, refunds and exchanges are handled in accordance with our Refund, Returns & Exchanges Policy and Australian Consumer Law.
Our voluntary change-of-mind policy is separate from your statutory consumer rights.
Any time limit applying to a voluntary change-of-mind return does not impose a time limit on rights that may exist under Australian Consumer Law.
The ACCC specifically warns businesses against statements suggesting consumer-guarantee rights disappear after an arbitrary number of days.

- Sale and Clearance Products
Sale and clearance products remain subject to applicable Australian Consumer Law consumer guarantees.
A product does not lose those rights merely because it was discounted.
However, our voluntary change-of-mind policy may exclude products identified as clearance or final sale.
Where a product was discounted because of a specific defect that was clearly disclosed before purchase, rights concerning that disclosed defect may differ according to Australian Consumer Law.
- Bulk, Childcare, Kindergarten and School Orders
We welcome orders from childcare centres, early learning services, kindergartens, schools, educators and other organisations.
Large or bulk orders may be subject to:
- product availability;
- agreed quotations;
- freight arrangements;
- lead times; and
- other terms disclosed before the order is accepted.
Where Australian Consumer Law applies to a business or organisational purchase, nothing in these Terms & Conditions excludes rights that cannot legally be excluded.
- Promotions and Discount Codes
Promotional codes and special offers may be subject to additional conditions displayed with the promotion.
Unless otherwise stated:
- discount codes cannot be exchanged for cash;
- a code may have an expiry date;
- minimum-spend requirements may apply;
- excluded products may apply; and
- multiple promotional codes may not be combinable.
Any promotional condition will operate subject to applicable law.
- Gift Cards
Where Koala Learning Resources offers gift cards, additional terms may apply.
Any gift-card expiry period and conditions will comply with applicable Australian requirements.
Gift cards cannot ordinarily be exchanged for cash except where required by law.
- Accounts and Passwords
If our website allows customers to create accounts, you are responsible for maintaining the confidentiality of your account credentials.
Please notify us if you reasonably believe your account has been accessed without authorisation.
We may suspend access where reasonably necessary to protect an account, our website or other customers.
- Reviews and User-Submitted Content
If customers can submit reviews, photographs, comments or other content, submitted material must not be:
- unlawful;
- defamatory;
- abusive;
- misleading;
- fraudulent;
- infringing of another person’s intellectual property or privacy rights; or

We endeavour to keep our website operational and secure but cannot guarantee uninterrupted access at all times.
Temporary interruptions may occur because of maintenance, technical issues, security measures or circumstances outside our reasonable control.
We may reasonably modify, maintain or update the website from time to time.

We may update these Terms & Conditions when reasonably necessary, including to reflect changes to our operations, website or applicable law.
The current version will be published on our website with an updated revision date.
Changes will apply prospectively and will not be used to unfairly remove rights already acquired under an existing transaction.
This is important because Australian unfair-contract-term rules specifically identify unilateral variation clauses as terms that may be unfair depending on the circumstances.
